306387157, Georgia), hereinafter referred to as the "Contractor," to enter into an Agreement for the provision of services for organizing and conducting tourist and excursion events (hikes, treks, jeep tours, corporate and international tours) with any individual or legal entity, hereinafter referred to as the "Client."
In accordance with Articles 329 and 331 of the Civil Code of Georgia, full or partial payment by the Client for the Contractor's services constitutes unconditional acceptance of the terms of this Agreement. From the moment payment is made, the Agreement is considered concluded in writing.
1. SUBJECT OF THE AGREEMENT1.1. HikingMax agrees to handle the booking, organization, and execution of your adventure (referred to as the "Event" / "Tour" / "Hike") based on the program listed on our official website (
https://hikingmax.com/en), and you agree to pay for these services and follow the rules set out in this Agreement.
1.2. Our adventures come in different formats: day hikes, multi-day treks, jeep tours, corporate programs, and international trips. Booking and cancellation rules depend on the format you choose (Section 4).
2. RIGHTS AND OBLIGATIONS2.1. HikingMax agrees to:2.1.1. Give the Client all the details about the Event program, difficulty level, gear requirements, and cost.
2.1.2. Run the Event as described, including everything in the price (transfers, hiking guides, group gear, first aid kit, etc., depending on your plan).
2.2. The Contractor has the right to:2.2.1. Change the route, schedule, or cancel/postpone the Event if the weather turns bad, there's a safety risk, or other force majeure happens.
2.2.2. Refuse the Client's participation (without a refund) if the Client arrives under the influence of alcohol or drugs, lacks mandatory gear (like hiking boots with proper grip for tough trails), or seriously violates safety rules and the guide's instructions.
2.3. The Client agrees to:2.3.1. Pay for the Event in full and on time.
2.3.2. Honestly and independently assess their own fitness level and health before signing up for an Event.
2.3.3. Show up at the starting point on time. If the Client is late, the transfer and the group won't wait, the service is considered delivered, and no refund will be issued.
2.3.4. Follow all safety rules and instructions from your guide or group leader throughout the entire trip without exception.
2.3.5. Take good care of any gear provided by HikingMax or our partners. If you lose or damage gear, you agree to cover its full market value.
3. PRICING AND PAYMENTS3.1. For our regular group trips, prices are listed on the HikingMax website and are locked in for you once you pay your deposit or prepayment.
3.1.1. For individual, corporate, and private group Tours designed by special request, the final price isn't fixed on the website. We calculate it based on your specific trip details, dates, group size, and services. The final price is agreed upon through our messages (email or messengers) and is officially set in the invoice or custom quote we send you.
3.2. Payment is made according to the specific Event type (prepayment, deposit, or full payment) via the website's payment systems or directly to the Provider's bank details.
3.3. The currency for transactions within Georgia is the Georgian Lari (GEL). For international transfers, payments can be made in other available currencies (USD, EUR) by prior agreement and at the Provider's exchange rate on the day the invoice is issued.
4. BOOKING, CANCELLATION, AND REFUND POLICYCancellation and refund rules depend strictly on the Event category:
4.1. ONE-DAY HIKES- Cancellation by the Client more than 3 days (72 hours) before the start before the start of the event — 100% of the paid amount is refunded.
- Cancellation by the Client between 3 and 2 days (72 to 48 hours) before the start of the event — 50% of the paid amount is refunded.
- Cancellation by the Client less than 2 days (48 hours) before the start of the event — a refund is not available.
- Alternative: Instead of a refund, the Client has the right to coordinate with the Contractor to transfer the deposit/payment to another Event from the Contractor's calendar.
4.2. MULTI-DAY HIKES AND JEEP TOURS- To book a spot, the Client pays a deposit of 20% of the total Tour cost.
- The price structure includes a fixed non-refundable deposit ranging from 10% to 20% of the total Tour cost, which covers our actual expenses for advance bookings (lodging, logistics).
- Cancellation by the Client more than 14 days before the start of the event — 10% of the total Tour cost (half of the paid deposit).
- Cancellation by the Client less than 14 days before the start of the event — the full amount of the paid deposit (20%) is retained by us and is non-refundable.
- Final payment: To finalize your booking, you must pay the remaining balance (80%) no later than 10 days before the Event starts.
4.3. INTERNATIONAL AND CORPORATE TOURS- To book your spot, the Client pays a non-refundable deposit of 20% of the total Tour cost. If the Client cancels the Tour, this deposit is non-refundable regardless of when the cancellation occurs.
- The Client must pay the remaining balance no later than 10 days before the event starts.
4.4. CANCELLATION OR RESCHEDULING BY THE OPERATOR- If the Event is canceled or rescheduled by the Operator (including cases of dangerous weather conditions), the Client will receive a full (100%) refund.
4.5. REFUND PROCEDURE- Refunds requested by the Client (in cases specified in clauses 4.1 and 4.2) are processed by the Operator within 14 business days after the Client's official written request. Payment system and bank fees for the refund transfer may be deducted from the total refund amount.
5. LIABILITY AND LIMITATION OF LIABILITY5.1. HikingMax is not responsible for any health issues, injuries, flare-ups of chronic conditions, or accidents occurring during the Trip if they result from the Client's physical condition, failure to follow safety rules, negligence, or ignoring the guide's instructions.
5.2. The Client is aware that mountain hiking is an active form of recreation and involves natural risks. The Client assumes all risks associated with potential injuries.
5.3.
Insurance: The Contractor does not include medical or sports insurance in the cost of Events. The Client is
required to independently obtain a proper insurance policy covering "active recreation / trekking / hiking" risks for the duration of the Event.
5.4. The Contractor is not responsible for the safety of the Client's personal belongings, documents, or equipment throughout the route.
6. DISPUTE RESOLUTION AND APPLICABLE LAW6.1. The Parties will try to resolve any disputes or disagreements arising from or related to this Agreement through friendly negotiations.
6.2. This Agreement is governed by, interpreted, and enforced in accordance with the current substantive and procedural
laws of Georgia.
6.3. If the Parties cannot reach an agreement out of court, the dispute will be settled in the court at the place of the Contractor's registration (Georgia).
